Introduction
Co-Splay ("we," "us," or "Platform") respects the intellectual property rights of others and expects our users to do the same. This Digital Millennium Copyright Act ("DMCA") Policy describes how we respond to claims of copyright infringement on our Platform in accordance with the DMCA (17 U.S.C. § 512).

Filing a DMCA Takedown Notice
If you believe that your copyrighted work has been copied and is accessible on the Platform in a way that constitutes copyright infringement, you may submit a notification to our Designated Agent. Your notice must include:
1. Physical or Electronic Signature
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of Copyrighted Work
Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list.
3. Identification of Infringing Material
Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URLs).
4. Contact Information
Your contact information, including your address, telephone number, and email address.
5. Good Faith Statement
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. Accuracy Statement
A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Response to Valid Takedown Notices
Upon receipt of a valid DMCA takedown notice, we will:
- Remove or disable access to the allegedly infringing material expeditiously, typically within 24–48 hours of receipt.
- Notify the user who posted the content that it has been removed or disabled ("Takedown Notification").
- Provide the user with information about filing a counter-notification if they believe the content was removed in error.
- Maintain records of the notice for compliance purposes.
Filing a Counter-Notification
If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Agent. Your counter-notification must include:
1. Physical or Electronic Signature
Your physical or electronic signature.
2. Identification of Removed Material
Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
3. Good Faith Statement
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Consent to Jurisdiction
A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the United States, the Federal District Court for the Middle District of Florida), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
5. Contact Information
Your name, address, and telephone number.
Response to Counter-Notifications
Upon receipt of a valid counter-notification, we will:
- Provide a copy of the counter-notification to the original complaining party.
- Inform the original complaining party that we will restore the removed material in 10 business days unless we receive notice that the complaining party has filed a court action seeking to restrain the user from engaging in infringing activity.
- Restore the removed material between 10 and 14 business days after receiving the counter-notification, unless we receive notice of court action from the original complaining party.
Repeat Infringer Policy
Co-Splay maintains a policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers. Our policy operates as follows:
First Offense: Content removed, warning issued, account noted.
Second Offense: Content removed, second warning issued, temporary suspension (7 days).
Third Offense: Content removed, permanent account termination.
We reserve the right to terminate any account at any time for a single instance of egregious infringement or in other appropriate circumstances. Factors we consider include:
- Nature and severity of the infringement
- Whether the user knew or should have known the material was infringing
- User's history on the Platform
- Any previous warnings or notifications received
- Whether the user has filed counter-notifications that were not contested
Misrepresentation Warning
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. Before filing a DMCA notice or counter-notification, please ensure you have a good faith basis for your claims.
Modifications to This Policy
We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting. Your continued use of the Platform after any changes constitutes acceptance of the modified policy.
Safe Harbor
Co-Splay qualifies for the safe harbor provisions of the DMCA by:
- Designating an agent to receive notifications of claimed infringement
- Implementing a repeat infringer policy
- Accommodating standard technical measures used by copyright owners
- Not interfering with such measures
- Responding expeditiously to valid takedown notices
